The purpose of this hearing is to receive comments on proposed changes to Title 72, Chapter 1 of the Nebraska Administrative Code (NAC) – Restrictive Housing. This Chapter establishes regulations surrounding the use of restrictive housing within NDCS to ensure such housing will be utilized in the least restrictive manner for the least amount of time consistent with the safety and security of staff, inmates and the facility. The proposed changes remove unnecessary language, address restrictions on the use of restrictive housing for vulnerable populations as prescribed under LB686 (2019), and update terminology. There is no expected fiscal impact on state agencies, political subdivisions, or persons being regulated.

Authority for these regulations is found in Neb. Rev. Stat. § 83-173.03(2) and Neb. Rev. Stat. § 84-907.
